Terms & Conditions
This is an agreement between "You" (the advertiser) and The Luxury Life Group for the provision of advertising services via the selected social media platforms listed in Schedule A. These terms and conditions are implied in all agreements for the provision of advertising services unless explicitly excluded.
Intellectual Property
- Intellectual Property
- You undertake that you possess the relevant legal rights for the reproduction, broadcast and use of the media provided for use.
- You agree to indemnify The Luxury Life Group, its agents and its employees for any damages, loss or compensation claim in relation to a breach of the undertaking in clause (1)(1).
- In the event that you do not possess the rights to the media used and The Luxury Life Group receives an infringement notice from Instagram or the rights holder, you agree to pay the liquidated damages of $15,000.00 USD for each notice received.
- In the event that you do not possess the rights to the media used and as a result one or more of The Luxury Life Group's social media pages is disabled as a result, you agree to pay liquidated damages of $100,000.00 USD per page disabled being a fair estimate of damages.
- Payment & Posting Terms
- All campaigns are pre-paid and credit terms are not to extended.
- In the event a campaign is not prepaid, the full sum is payable within 2 working days.
- You acknowledge that The Luxury Life Group retains absolute discretion in:
- the timing of posting and publication of all promotions;
- the modification of captions;
- the length/time each publication is made available; and
- rejecting media deemed not to be inline with our theme.
- Jurisdiction
- This agreement is governed by the law in the State of New South Wales in the Commonwealth of Australia.
- You agree to submit to the forum and jurisdiction of any New South Wales Court with jurisdiction to hear any dispute.
